Netherlands: Fixed Term Contract Changes
Due to the importance of the changes, we provide a timely reminder below:
- For contracts with a duration of six months or shorter than six months, a probationary period is no longer allowed. If the contract period is six months and one day, it is allowed
- Non–competition clauses should not be included unless there are compelling reasons
- Fixed term contracts longer than 6 months must be explicitly cancelled or extended in writing no later than 1 month prior to its expiry
- From July 1, fixed term contracts will be limited – a maximum of 3 consecutive contracts over a maximum of 2 years before the employment is considered permanent (the contracts will be consecutive if the gap between them is less than 6 months).
It is suggested that any contract templates are amended to take account of the changes - our HR team can help you with any redrafts, and drafting new documentation required in the future.
